- Object of agreement
OTrade Hiltbrunner sells the goods offered in the online shop to the terms and conditions hereafter.
- Closing of contract
A deal between the client and OTrade Hiltbrunner will be closed only by an order by the client and its acceptance by OTrade Hiltbrunner. The order takes place normally via internet. OTrade Hiltbrunner accepts the order by either (a) sending an order acknowledgement (by Fax, Email or Letter Post) or (b) by deliver the goods including invoice. (Order receipt is not yet an order acknowledgement).
- Product offering
All specifications to the goods, witch the client receives during the ordering process, are subjects to change without notice, specially changes in the design and technique, who improves the function of the goods, and false descriptions, illustrations and mistakes in price. If prices change on short term, the client will be informed as soon as possible and he has the option to deny the order. All technical information to the goods is based on the descriptions by the manufacturer and is therefore firm.
- Payment terms
The prices published are target prices, witch can be adjust according to the market. Prices are in CHF, Euro or US$, excluding VAT, packaging and post taxes ex warehouse Baar, 6340 (Switzerland). Packaging cost and post taxes according to Swiss post international will be calculated individually and added to the cost of goods. The payment can be done by the options given by the internet shop. The net payment has to arrive within 14 days after date of purchase. If the payment is delayed, OTrade Hiltbrunner is authorized, to give the costumers name and address to the Collection Partner. Any delayed payment will be charged by a penalty of CHF 10,00. OTrade Hiltbrunner has the right, to deliver certain customers only by pre payment.
Custom and vat for abroad deliveries must be covered by the customer .
- Conditions of delivery
Goods available on stock will be shipped normally within 48 hours to the address given by the customer. If by any reason the delivery will take more than 7 days, a written order acknowledgement with the expected delivery time will be sent. The mentioned delivery time is given according to the best guess but without guarantee. This, specially in the chase of delayed delivery by the manufacturer.
- Ownership
The delivered goods are owned by OTrade Hiltbrunner till complete payment. He is authorized to register the ownership in the corresponding register of ownership. If the payment delays, OTrade Hiltbrunner has the right to reject from the contract and to collect the goods.
- Warranty
Any warranty claim is limited to the warranty given by the manufacturer of the products. If the customer claims in written form within seven working days upon receipt, he receives a replacement free of charge. No guarantee is given if customer has made changes or repairs on the good without prior written acceptance by OTrade Hiltbrunner Compensation for damages is excluded according to the law. OTrade Hiltbrunner is not responsible for damages which are caused by improper use or natural abrasion or for damages which are not caused by the product it selves. (Consequential damage from failings).
- Terms & Conditions
These terms and conditions and the contracts closed, based on these terms and conditions are subjects on Swiss laws. UN-right of buy (CISG) are excluded. Place of jurisdiction is Zug, 6300 / Switzerland.
- Final provisions
The purcase of the goods offered by OTrade Hiltbrunner is subject to the terms and conditions valid at the time of deal closing. These terms and conditions are overriding any different terms and conditions the customer may have. In the case that some articles of the actual terms and conditions become effectless by any reason, the effect of the remaining articles will not be effected. These terms and conditions are subject to changes by OTrade Hiltbrunner only.
